DECLARATION / HEALTH AND SAFETY AGREEMENT / INDUCTION, IF REQUESTED  

BODY TECH WINSFORD LTD

MEMBERSHIP TERMS, CONDITIONS & HEALTH AND SAFETY AGREEMENT

These Terms and Conditions apply to all members of Body Tech Winsford Ltd. By joining and using the facilities, members agree to comply with the following:

Membership

  • Membership includes access to gym facilities during advertised opening hours
  • An induction will be provided where required
  • Memberships are strictly personal to the named member
  • Memberships may not be shared, transferred, or used by any other person
  • Body Tech Winsford Ltd reserves the right to refuse admission or terminate membership where rules are breached
  • Facilities, services, opening hours, and pricing may change with reasonable notice
  • Memberships are non-transferable and not refundable except where required by law

Cancellation Policy

  • Memberships must be cancelled at least five (5) working days before the next Direct Debit date
  • Cancellation must be submitted via the designated contact form on our website
  • Payments due within the notice period will still be collected
  • Refunds are not normally issued for partial months except where required by law
  • Cancellations are valid once confirmation has been issued
  • If confirmation is not received within 48 hours, members should follow up
  • Cancellation will be treated as effective from the original submission date
  • Members who cancel will not be eligible for promotional offers for 56 days

Membership Freeze

  • Memberships cannot normally be frozen
  • Freeze requests may be considered in exceptional circumstances such as medical reasons
  • Freeze approval is at management discretion

Health & Fitness

  • Members confirm they are physically fit to exercise
  • Members must inform staff of any relevant health conditions
  • PAR-Q health questionnaires must be completed where requested
  • Members exercise at their own risk
  • Members are responsible for monitoring their own physical condition

Under 18 Policy

  • Members aged 13–15 must be accompanied and supervised by a responsible adult at all times
  • Members aged 16–17 may use the gym independently following induction
  • All under 18s must complete:
    • Full gym induction
    • Parent/guardian consent
    • Health screening questionnaire
  • Under 18s will only be permitted access once documentation is approved

Sauna Use

  • Sauna is strictly for members aged 18 and over
  • Sauna may only be used during staffed hours
  • All posted safety guidance must be followed

Sunbed Use

  • Sunbeds are strictly for members aged 18 and over
  • Proof of age may be requested
  • Safety instructions must be followed before use

Studio Use

  • The studio may only be used during scheduled classes
  • A member of staff must be present
  • Independent studio use is not permitted unless authorised

Gym Conduct & Safety

Members must:

  • Return weights and equipment after use
  • Unload machines after use
  • Not lean weights against walls or machines
  • Not leave equipment on the floor
  • Wipe down machines before and after use
  • Dispose of rubbish in bins provided
  • Wear suitable clothing and footwear
  • Use a towel where possible
  • Maintain good personal hygiene
  • Report spills immediately
  • Report damaged equipment immediately
  • Follow all signage and staff instructions

Additionally:

  • Members must not train under the influence of alcohol or drugs
  • Members should train individually or in a maximum of two people
  • Group training around machines or equipment is not permitted

Equipment Use

  • Members must only use equipment they understand
  • Staff assistance should be requested if unsure

Equipment Damage

  • Members may be held responsible for damage caused through misuse or negligence

Behaviour Policy

  • Abusive, threatening, discriminatory, or inappropriate behaviour will not be tolerated
  • Breaches may result in suspension or termination of membership

Access Control

  • Members must not allow non-members access to the gym
  • Breaches may result in termination of membership
  • Lost or damaged fobs will incur a £5 replacement fee

Personal Training

  • Only authorised Body Tech Winsford Ltd staff or approved trainers may provide coaching
  • Unauthorised coaching of other members is not permitted

Opening Hours & Staffing

  • Facilities may operate with or without staff present
  • Members use the gym during unstaffed hours at their own risk
  • The gym may close temporarily for maintenance or events

Emergency Procedures

  • Members must follow staff instructions in an emergency
  • Fire exits must not be obstructed
  • Members must evacuate when instructed

Accident Reporting

  • All accidents or injuries must be reported immediately to staff
  • Incidents will be recorded in the accident book

Classes & Bookings

  • Class cancellations must be made with at least 24 hours' notice
  • Cancellations must be emailed to cheshirewest@bodytechfitness.co.uk
  • Failure to provide notice may result in booking restrictions

Personal Belongings

  • Body Tech Winsford Ltd accepts no responsibility for loss, theft, or damage to belongings
  • Liability for death or personal injury caused by negligence is not excluded

Lockers & Lost Property

  • Lockers are for day use only
  • Items left overnight may be removed
  • Lost property will be disposed of if unclaimed

Smoking & Vaping

  • Smoking and vaping are not permitted inside the premises

Mobile Phone Use

  • Phone use must not interfere with other members
  • Calls should be taken outside training areas

CCTV

  • CCTV operates for security and safety purposes
  • Images are processed in accordance with UK data protection legislation

Photography & Live Filming

  • Photography or video may be taken for promotional purposes
  • Members may appear incidentally in background footage
  • Members wishing to opt out must notify a member of staff
  • Members must not film others without consent
  • Filming must not interfere with others' use of the gym

Data Protection

  • Personal information is processed in accordance with UK data protection legislation
  • Data is used for membership administration only

Promotional Offers

  • Promotional items must be collected within 30 days of purchase

General

  • Failure to comply with rules may result in suspension or termination
  • Terms may be updated from time to time
  • The latest version will always be available on our website
